AIR QUALITY ROUTER END-USER LICENSE AGREEMENT Effective date: 13 July 2026 This End-User License Agreement ("Agreement") is between the person or entity accepting it ("Licensee") and Dot 1 Technologies VBA, established in Aruba ("Application Provider"), for Air Quality Router on iPhone, iPad, Apple Watch, and Mac, including related updates and services (the "Licensed Application"). 1. Acknowledgement and parties This Agreement is concluded between Licensee and the Application Provider, not Apple. The Application Provider, not Apple, is solely responsible for the Licensed Application and its content, subject to this Agreement. This Agreement may not provide usage rules that conflict with the Apple Media Services Terms and Conditions in effect on the date this Agreement is accepted. 2. Scope of licence The Application Provider grants Licensee a limited, non-exclusive, non-transferable, revocable licence to use the Licensed Application on Apple-branded products owned or controlled by Licensee, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions. The Licensed Application may also be accessed and used by other accounts associated with the purchaser through Family Sharing or volume purchasing where Apple permits that use. No ownership interest is transferred. Except where applicable law permits otherwise, Licensee must not copy, modify, reverse engineer, decompile, distribute, sell, lease, sublicense, or commercially exploit the Licensed Application. 3. Maintenance and support The Application Provider is solely responsible for maintenance and support of the Licensed Application as specified by applicable law or this Agreement. Apple has no obligation to furnish maintenance or support services for the Licensed Application. Support is available from the Application Provider at apps@dot1.tech and the public support page at https://aqrouterapp.dot1.tech/support/. 4. Warranty The Licensed Application is provided on an "as is" and "as available" basis to the maximum extent permitted by applicable law. If the Licensed Application fails to conform to an applicable warranty, Licensee may notify Apple, and Apple may refund the purchase price, if any, in accordance with Apple's rules. To the maximum extent permitted by applicable law, Apple has no other warranty obligation for the Licensed Application. The Application Provider is solely responsible for any other warranties, claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to an applicable warranty. Nothing in this Agreement excludes a warranty or remedy that cannot lawfully be excluded. 5. Product claims and regulated use The Application Provider, not Apple, is responsible for addressing claims relating to the Licensed Application or possession and use of it, including product-liability claims; claims that the Licensed Application fails to conform to a legal or regulatory requirement; and claims arising under consumer-protection, privacy, or similar legislation, including claims connected with HealthKit. Air Quality Router is a planning and awareness tool. It is not a medical device, personal exposure monitor, emergency service, medical advice, diagnosis, treatment, fitness assessment, or guarantee of health or safety. AQI values and route comparisons are estimates derived from nearby readings, forecasts, cached results, provider availability, network conditions, time, and route context. They may be stale, incomplete, unavailable, or materially different from official guidance and conditions actually encountered. Local authority advice and qualified medical advice take priority. 6. Real-time route guidance and outdoor conditions YOUR USE OF THIS REAL TIME ROUTE GUIDANCE APPLICATION IS AT YOUR SOLE RISK. LOCATION DATA MAY NOT BE ACCURATE. GPS, compass, map, route, distance, progress, arrival, and off-course information may be delayed, incomplete, unavailable, or inaccurate. Roads, footpaths, access rights, closures, construction, terrain, weather, traffic, lighting, hazards, and local restrictions can change without appearing in the Licensed Application. The Licensed Application does not verify that a route is legally accessible, physically suitable, open, supervised, or safe. Licensee remains responsible for attention to surroundings, posted signs, local law, access restrictions, equipment, weather, traffic, personal condition, and independent judgement. Interaction with a device must not distract from walking or create danger. Guidance must not be used for emergency response, rescue, evacuation, aviation, maritime navigation, or any situation in which inaccurate or delayed information could cause death, injury, property damage, or environmental harm. Apple Maps and other third-party services may apply separate terms and may be interrupted or changed. 7. Apple Health and location data With permission, the Apple Watch experience may create a standard walking workout and workout route in Apple Health. The Licensed Application passes actual workout-route coordinates on device to HealthKit. Air Quality Router does not create an app-managed workout history or app-managed iCloud workout record and does not transmit those completed-route coordinates to an Application Provider server, proxy, air-quality provider, advertising system, or analytics system. After a record is saved in Apple Health, Apple may store or synchronize it through iCloud according to Apple Account and Health settings; that Apple system behavior is not controlled by the Application Provider. Temporary planned-course information and minimal recovery state may be held on device only as needed to stage, guide, recover, or finish the active walk, then deleted according to the product's documented lifecycle. Health and precise-location permissions are optional and can be denied or revoked in Apple system settings. Denial prevents Guided AQI-Aware Walk but does not prevent ordinary route planning or opening a route in Apple Maps. Deleting or changing Health data is controlled through Apple Health and Apple system facilities. HealthKit data must not be used in violation of applicable law or Apple's terms. Coordinates used to obtain nearby air-quality snapshots may be transmitted to the configured Air Quality Router proxy as described in the Privacy Policy. Actual completed workout-route coordinates are not sent to air-quality providers. The completion recap describes the AQI estimate frozen for the planned route at the start; it is not a measurement of the completed path or personal exposure. 8. Intellectual-property claims If a third party claims that the Licensed Application or Licensee's possession and use of it infringes that party's intellectual-property rights, the Application Provider, not Apple, is solely responsible for investigation, defence, settlement, and discharge of the claim. OpenAQ, source-provider, Copernicus, ECMWF, European Union, Apple, Apple Maps, and other names remain the property of their respective owners. Attribution does not imply endorsement. 9. Legal compliance Licensee represents and warrants that Licensee is not located in a country or region subject to a United States Government embargo or designated by the United States Government as a terrorist-supporting country, and is not listed on any United States Government list of prohibited or restricted parties. Use must comply with applicable export-control, sanctions, health, privacy, access, traffic, and local laws. 10. Third-party terms and services Use of the Licensed Application must comply with applicable third-party terms, including Apple Media Services, Apple Maps, HealthKit, OpenAQ, source-provider, CAMS/Copernicus Atmosphere Data Store, network-provider, and device terms. Third-party data and services may be unavailable, changed, rate-limited, corrected, or discontinued. The Application Provider does not control or warrant third-party data, maps, routes, networks, or services. 12. Purchases and subscriptions Starter access is included with the paid app purchase as described on the App Store product page. Air Quality Router Plus is an optional auto-renewable subscription managed by Apple. Current price, period, renewal, cancellation, billing, refund, Family Sharing, and territory availability are shown by Apple at purchase. Subscription management and cancellation occur through Apple account settings. Features requiring Plus are unavailable when Apple does not report a valid entitlement. An active workout will not be ended solely because entitlement status changes during that workout. 13. Privacy The Privacy Policy at https://aqrouterapp.dot1.tech/privacy/ describes processing of location, settings, Calendar, iCloud, HealthKit, diagnostic, and support information. No third-party advertising or analytics is included. Diagnostic information remains local unless deliberately shared for support. Support communications contain information voluntarily supplied by the sender. 14. Limitation of liability To the maximum extent permitted by applicable law, the Application Provider is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages; loss of data, opportunity, profits, or goodwill; or injury, loss, or damage arising from reliance on AQI, route, map, location, workout, or third-party information. This limitation does not exclude liability that cannot lawfully be excluded, including liability arising from fraud, wilful misconduct, gross negligence where applicable, death or personal injury caused by negligence where applicable, or mandatory consumer rights. Any limitation or exclusion is applied only to the extent valid under the law governing the particular claim. 15. Termination This Agreement remains effective until terminated. It terminates automatically if Licensee materially breaches it. On termination, use of the Licensed Application must cease and copies under Licensee's control must be deleted, without affecting Health data retained under Apple's controls or rights and obligations that by their nature survive termination. 16. Governing law, courts, and mandatory rights This Agreement is governed by the laws of Aruba, without regard to conflict-of-law rules. The competent courts of Aruba have nonexclusive jurisdiction. This choice does not deprive a consumer of mandatory protections or a right to bring proceedings in another court that cannot be waived under the law of the consumer's habitual residence or another applicable law. Nothing in this Agreement requires arbitration, waives participation in a class or representative action, or limits a non-waivable statutory remedy. 17. Apple as third-party beneficiary Apple and Apple's subsidiaries are third-party beneficiaries of this Agreement. Upon Licensee's acceptance, Apple has the right, and is deemed to have accepted the right, to enforce this Agreement against Licensee as a third-party beneficiary. 18. Entire agreement and severability This Agreement, the Privacy Policy, and the terms presented by Apple at purchase form the agreement governing the Licensed Application. If a provision is held invalid or unenforceable, it will be limited or severed only to the minimum extent necessary, and the remaining provisions continue in effect. A failure to enforce a provision is not a waiver.
